<p>Zoey&#8217;s Story could not be more grateful to both the local <a href="http://www.nbcnewyork.com/news/local/133586508.html" target="_blank">NBC affiliate, WNBC,</a> the <a href="http://www.humanesociety.org/">Humane Society of the United States</a> and the website <a href="http://gothamist.com/2011/11/10/puppy_mills_1.php" target="_blank">Gothamist </a>for doing a story this past week on pet stores in Manhattan, specifically focusing on the fact that the puppies these stores sell come from puppy mills, despite what the owners claim (that they come from local breeders).</p>

<p>It&#8217;s even more exciting that one of the stores that was featured was Raising Rover and Baby, the one and only place where I bought Zoey; remember as well that the owners and employees adamantly promised me beforehand that Zoey was NOT from a puppy mill.  As a bit of background, I had shopped at Raising Rover and Baby for supplies for my older dog, Abby, who was rescued from the <a href="http://www.sebastiancountyhumanesociety.org/">Sebastian County Humane Society</a>.  When I started thinking about getting a second dog, I questioned the owners, with whom I believed I had a good relationship, about where they got their dogs from, noting that because I was from the South, I was aware of puppy mills and specifically did not want a dog that came from one.  In response, the owner showed me his license from the USDA and stated adamantly that the dogs in his store were bred either by himself and/or by close friends/acquaintances on Long Island and upstate New York that he had known for over 20 years.  On this promise, I decided to go ahead with the purchase.</p>
<p><a href="http://www.zoeystory.com/from-the-beginning-the-abbreviated-version/dscn0396/" rel="attachment wp-att-72"><img class="alignleft size-medium wp-image-72" title="A very sick Zoey" src="http://www.zoeystory.com/wp-content/uploads/2009/08/dscn0396-300x225.jpg" alt="" width="300" height="225" /></a>Zoey became deathly ill the day after I purchased her, eventually necessitating her admission to an ICU for 3 days; had I not taken her to a pet hospital and instead listened to the advice of the vet Raising Rover suggested I use (that I take her home and &#8220;monitor her condition overnight&#8221;), she surely would have died.  While Zoey was in the ICU, I asked for and was provided her breeding information.  This was when I discovered that she was NOT from Long Island or New York state but instead had been born in Wheatland, Missouri.  I was infuriated that the owners of Raising Rover had lied to me about where Zoey had been bred.  When I confronted the owner with this new information, he immediately backtracked on his prior statements, claiming that he had never promised me that he uses local breeders.  Either way, I was horrified by what had transpired (and Zoey was still not out of the woods as yet).</p>

<p>Longtime readers know that this story has a happy ending: thanks to the efforts of the vets at New York Vet Specialists, Zoey survived and has made the most of every moment since.  Her unbelievably outgoing personality and always-upbeat attitude provides everyone who knows her with endless smiles and entertainment.  But I still shudder at the thought of what this little dog was forced to endure for the first two-plus months of her life, bred to two puppy-making machines in Missouri, ripped from her mother before she was fully weaned, shipped to NYC under terrible conditions, and cooped up in a pet store for a few weeks, as if on parade for her eventual owner.  It is this story, Zoey&#8217;s Story, and those of so many other dogs forced to endure similar-such lives without their own happy endings, that I started this blog and my non-profit, Protected Paws.  I know change won&#8217;t come quickly or easily, but with the help of reporting like the story done this week by WNBC and others, we hope that hearts and minds will eventually come to understand that people should adopt rather than shop, and advocate for legislative and regulatory change that ends the large-scale puppy breeding industry once and for all.</p>
<p>For those who might be new to Zoey&#8217;s Story, below is the complaint I filed with the USDA, which summarizes the case:</p>
<p>Description of Complaint:  Puppy (Zoey) purchased on 04/06/09 with DOB:  01/19/09.  Customer who is aware of large-scale breeding facilities throughout the mid-west questioned the owner regarding the breeder.  The owner explained that the dog (Zoey) was “bred locally in Long Island, NY by breeders he had personally known for close to 20 years.”  I put a small deposit down to “hold” the dog while making a final determination that I wanted it and then paid the remaining amount on 04/07/09.  NYS General Business Law 753-B states that “every pet dealer shall provide the Breeder’s Name and Address of the source of the animal. “ Under this section on the contract between the pet store and customer there is no identification number and a signature that is illegible which was signed at the time of the purchase in the pet store (Contract available upon request).<a href="http://www.zoeystory.com/from-the-beginning-the-abbreviated-version/pet-contract-continued1/" rel="attachment wp-att-1846"><img class="alignleft size-medium wp-image-1846" title="Pet Contract " src="http://www.zoeystory.com/wp-content/uploads/2011/11/Pet-Contract-continued1-247x300.jpg" alt="" width="247" height="300" /></a></p>
<p>The dog vomited on the way home from the establishment on 04/07/09.  The dog continued to vomit numerous times through the entire next day, 04/08/09.  I called the store to express concern and was told to take our dog to East Side Animal Hospital, the pet store’s “preferred” veterinarian.  The dog was seen on 04/09/09 by a veterinarian at East Side Animal Hospital under terms of a free medical check up with proof of purchase at Raising Rover and Baby.  Upon leaving the veterinary practice, I called Raising Rover and Baby to inform them of what was transpiring.  At that moment, the veterinarian from East Side Animal Hospital was on the phone with the owner of Raising Rover and Baby, providing him with a full medical update without my (the dog owner’s) approval.</p>
<p>The dog was treated at East Side Animal Hospital for approximately 6 hours on 04/09/09 until my return at 5 PM.  At that time, the dog was returned to me with no firm diagnosis; the vet who treated her indicated that she would be fine to get her rest at home and bring her back in on 04/10/09 to continue fluids and rehydration.  East Side Animal Hospital does not provide 24-hour care, making overnight observation impossible.</p>
<p>Because my dog could not walk or even hold her head up, I became extremely concerned upon leaving East Side Animal Hospital and took the dog directly to NY Vet Specialists for another opinion (records available upon request).  The dog was immediately examined and admitted directly into the Intensive Care Unit.</p>
<p>NY Vet Specialists reviewed the dog’s medical records, at which point it was brought to my attention that the vet who initially saw the dog as a puppy was located in Missouri.  This was the first indication that I had been lied to by the pet storeowner, so I called him immediately to obtain the puppy’s true place of origin.</p>

<p>There is a possibility that there is a violation of Section 65-3 regarding the health certificate being submitted to the New York Department of Agriculture and Markets for an imported dog or he simply just lied to me. The Pet storeowner subsequently provided the name and phone number of the breeder, Evelyn Brinlee (“Brinlee”) of Wheatland, Missouri.  I spoke with Brinlee that evening in order to obtain information regarding the dog’s previous care.  She verbally provided some of this information and politely told me that if my dog died she would just send me another one with the shipment she had coming to New York the following week.</p>

<p>While the dog was in ICU, the owner of Raising Rover and Baby repeatedly called my home and cell phone requesting that I take the dog back to “their vet.”  I refused due to what I believed to be the inadequate initial treatment at East Side Animal Hospital and the subsequent disclosure that East Side Animal Hospital was providing all new medical information to the storeowner, not the dog owner.  The storeowner also repeatedly called NY Vet Specialists to request information and attempt to have my dog’s care moved back to East Side Animal Hospital.  Consequently, I had to instruct NY Vet Specialists to stop any and all contact with anyone associated with Raising Rover and Baby and East Side Animal Hospital.</p>
<p>My dog was released after 3 days in the ICU on 04/11/09 with strict dietary restrictions and medications (medical records available upon request).</p>
<p>Subsequent to the dog’s release, I reviewed the contract with Raising Rover and Baby, which indicated that “under NO circumstances will the purchaser ever receive a refund” even though this is expressly not prohibited by the N.Y.S. General Business Law, Article 35-D which covers the sale of cats and dogs Once I informed the owner that I was aware of my rights under Article 35-D, I was given a refund of $2200 for the purchase price of the dog.  Taxes on the $2200 were NOT included on the $2200, nor were the costs of medical care, which slightly exceeded the cost of the dog.</p>
<p>Subsequent to these events and after Zoey began to recover, I contacted a non-profit for help and subsequently visited the large-scale breeding facility in Wheatland, MO, where my dog was bred in January.   I also attended an open kennel auction conducted by the facility’s owner, Brinlee, in August.  At said auction, more than 300 dogs (not including puppies) were sold, including both my dog’s sire and dam.  I also met Brinlee and spoke with her for a substantial period of time.</p>

<p>Unaware that I was the pet’s owner, Evelyn Brinlee later commented to another person the puppy I had purchased was not a purebred Coton de Tulear but was in fact a Coton mixed with a black and white poodle.<a href="http://www.zoeystory.com/from-the-beginning-the-abbreviated-version/dscn0666-copy/" rel="attachment wp-att-1883"><img class="alignright size-medium wp-image-1883" title="Please note #83 on catalog and #83 on the dog tag" src="http://www.zoeystory.com/wp-content/uploads/2011/11/DSCN0666-copy-e1321218810624-225x300.jpg" alt="" width="225" height="300" /></a></p>
<p>Over the course of my research, I also discovered that Raising Rover and Baby had puppies listed for sale on approximately 15 different websites.  Approximately 2 months after purchase, I also noticed that the pet store was using images of my dog to solicit offers on other Coton de Tulear dogs.  Raising Rover and Baby was also using my dog’s likeness to advertise that, “we sell MICRO TEACUP, TOY and MINIATURE PUPPIES, which are bred by myself and local friends.”  This advertisement also indicated that the dog for sale was “AKC registerable,” even though it is believed by me based on knowledge and information that AKC currently does not allow Coton de Tulears to be registered under its auspices.  The advertisement also cited a “health certificate, health guarantee and pedigree.”  <a href="http://www.zoeystory.com/from-the-beginning-the-abbreviated-version/apri-registration/" rel="attachment wp-att-1847"><img class="alignright size-medium wp-image-1847" title="APRI Registration showing the birthplace of WHEATLAND, MO" src="http://www.zoeystory.com/wp-content/uploads/2011/11/APRI-Registration-231x300.jpg" alt="" width="231" height="300" /></a></p>
<p>I found pictures of my dog on 5 different websites advertising my dog for $600-$1000 less than what the store owner charged us (puppyfind.com, hoobly.com, kijiji.com, k9stud.com, etc.)  (Images available upon request).  In addition, some of the advertisements listed my dog’s birth date as different than was actually the case.  I immediately contacted the Internet company hosting the website and had the photos removed from the site.  As late as November 2009, Raising Rover and Baby continued to use my dog’s photo to promote the sale of other Coton de Tulear dogs in their store.  <a href="http://www.zoeystory.com/from-the-beginning-the-abbreviated-version/zoeyad1/" rel="attachment wp-att-93"><img class="alignright size-medium wp-image-93" title="Zoey Advertisement " src="http://www.zoeystory.com/wp-content/uploads/2009/08/zoeyad1-300x278.png" alt="" width="300" height="278" /></a></p>
<p>Raising Rover and Baby currently has more than 146 dogs for sale on one website alone, even though the owner promises that his puppies are, “always healthy and “I am a real person with real puppies and not an Internet farmer or scammer.”</p>
<p>I seek for the New York Department of Agriculture and Markets (perhaps in conjunction with the AG’s office or city officials) to investigate these claims, and if information comes to light to show these violations that the appropriate action will be taken in accordance with the applicable laws.</p>

<p>It was five years ago TODAY that I adopted Abby (lil&#8217; Zoey&#8217;s sister) from the Sebastian County Humane Society.  It was one of the most momentous days in my life.  For the small price of $80 I found my best friend.  When I first saw Abby, she was a large, matted, black and gray scruffy dog.</p>

<p> I was still living in Arkansas and volunteering with the Junior League of Fort Smith; I was on a tour of the local Humane Society with a great group of kids.  I just kept noticing a medium sized dog rubbing her body on the wires of the cage and then licking the bars; she clearly wanted out.  I went in with no intention of getting a dog.  I had lost my first dog, Lady, a few years earlier and that loss was still so fresh and affecting that I didn&#8217;t think I would ever get another dog.  But clearly life had a different plan.</p>
<p>I returned to the Humane Society a few more times, and each time the sight of this dog had an unexpectedly large impact on me.  I just couldn&#8217;t get her out of my head.  Something inside of me told me that I needed to adopt this dog; I can&#8217;t explain it, it was just a strong feeling.  I decided to just jump in, overlooking whatever concerns I might have.  Her name was either going to be Abby or Zoey.  But there was really no choice; she was always an Abby to me.</p>

<p>When I picked Abby up, I walked her out to the parking lot.  I was planning to put her in my car.  After all, what pound dog would know how to get into one?  Instead, Abby just jumped into the driver&#8217;s seat and then walked onto the passenger seat.  Clearly, she was quite familiar with the concept of automobiles (as is the case to this day, nothing makes her happier than riding in a car, including sticking her head out the window) and she just wagged her tail all the way to Petco.  And so our adventure began.</p>
<p>I took Abby to get groomed that day and was amazed with what appeared when I came back.  My supposed 25 lb. dog was now just 12 or so.  All her hair was gone, and in its place was a somewhat scared, yet also vibrant, loving and playful animal.</p>

<p>Abby has been my sidekick through thick and thin.  My friends all know that I consider Abby (and Zoey for that matter) to be my child but more than anything she is my friend.  She was with me when I bought my first house in Arkansas.  She was with me when I decided to uproot my life and move to Manhattan.  She watched with concern as I began hyperventilating when the Mayflower moving truck pulled out of my driveway in Fort Smith, signifying that I was finally on the fast track to the Big Apple, with no turning back.  She jumped into the car with a huge smile on her face, just like she did outside of the Humane Society, as we took off to drive to New York City.  She was with me every step of the way.  And during those first days in New York, which were filled with concern, wonder and the unknown, she never left my side.  She was a source of strength and constancy that gave me comfort and happiness.  I relished coming home to her jumping on my leg, smiling at me and sitting by my side.</p>
<p>In fact, that&#8217;s usually where you can find Abby &#8212; by my side.  She is a great cuddler, keeping me warm in the winter.  She is incredibly perceptive, drying my tears (literally licking them) when I&#8217;m sad.  She is a friendly, happy presence in my home, running to meet me at the door when I get home, if she isn&#8217;t there already, jumping as high as she can as the elevator beeps on its way up.  She is alternately playful and sweet.</p>
<p>Abby and Zoey couldn&#8217;t be any more different.  Whereas Zoey is a total extrovert and ham, immediately rushing toward every new person that comes into her life, Abby is reserved and slow to warm to newcomers.  Most people consequently gravitate to Zoey at first blush.  But those who spend a lot of time with the girls always end up falling in love with Abby.    Just last week, someone who&#8217;s known both girls for a while but had never spent much time with them, told us that after two straight weeks with them, he &#8220;really loves&#8221; Abby and commented repeatedly on how good a dog she is.  Abby&#8217;s dignity, sweetness and obedience grows on everyone she comes into contact with for a lengthy period of time.  She&#8217;s simply impossible not to love.</p>

<p>Interestingly, it&#8217;s because of Abby that we even decided to get Zoey.  Abby suffers from intense separation anxiety, pouting deeply when she knows she&#8217;s about to be left alone (in a particularly funny episode earlier this year, she ran outside and literally played dead, thinking that might stop me from leaving for dinner).  I thought getting a second dog to spend the day with, sharing the house, would make her less lonely.  That concept started the long process that eventually led us to Zoey.</p>

<p>Abby has been with me to Boston, Washington D.C., Detroit, Maine, South Carolina, Memphis, and numerous trips to the Virgin Islands.  She&#8217;s become such a great traveler, happily going into her carrier and sleeping when I put her under the airline seat.  Seatmates have commented numerous times that they can&#8217;t believe I had a dog with me.  And she so loves the wind, sun and warm weather that it gives me so much pleasure to watch her enjoy the Caribbean during winter.</p>

<p>Seventy-three dogs including Cocker Spaniels, Labrador Retrievers, American Eskimos, Poodles, Beagles, Papillons and Brussels Griffons were rescued by the Humane Society of Missouri on Thursday, July 14th in Monett (Lawrence County) Missouri.</p>

<p>This will be the first puppy mill put out of business since the new <a href="http://www.senate.mo.gov/11info/BTS_Web/Bill.aspx?SessionType=R&amp;BillID=4075538" target="_blank">Canine Prevention Cruelty Act</a>. Missouri&#8217;s <a href="http://ago.mo.gov/" target="_blank">Attorney General, Chris Koster</a>, promised that this is just the beginning of their efforts to improve Missouri&#8217;s dog breeding reputation.</p>
<p>Here are a few of the violations from the inspection reports:</p>
<ul>
	<li>Failed to provide adequate veterinary care to animals in medical distress</li>
	<li>Failed to clean and sanitize the facility</li>
	<li>Facility allowed excrement in food receptacles and dirty, muddy drinking water.  In some places feces had accumulated to the point it was indistinguishable from the flooring.</li>
	<li>Failed to keep sick, aged, or young animals in indoor or sheltered housing facilities.</li>
	<li>No drainage to keep animal waste and water eliminated so the animals stay dry and had shelter</li>
	<li>
<h2>The owner routinely used gunshot as a means of euthanasia, also in violation of the law.</h2>

<p>An agreement approved July 14 and enforceable under the circuit court, the owner will surrender all animals to the Humane Society of Missouri, surrender her Missouri Department of Agriculture commercial breeder license and will not operate a dog breeding facility for at least the next 6 years.  What we want to know is if the breeder will be criminally charged?  Per this act each violation carries with it a class C misdemeanor.  If Missouri really wants to clean up their reputation as the puppy mill capitol we believe a good start would be to fully enforce the consequences of the act. The rescued animals were taken to the <a href="http://www.hsmo.org/" target="_blank">Humane Society of Missouri&#8217;s Headquarters</a> for individual veterinary exams and treatment. As soon as they are healthy, as many of them as possible will be made available for adoption.</p>

<p>Governor Jay Nixon signed two bills yesterday.  Bills <a href="http://www.senate.mo.gov/11info/BTS_Web/BillText.aspx?SessionType=R&amp;BillID=4075538">S.B. 113</a> and <a href=" http://www.senate.mo.gov/11info/BTS_Web/Bill.aspx?SessionType=R&amp;BillID=4091895">S.B 161</a> did the following:</p>
<ul>
	<li>Maximum fee for operating certain dog facilities was $500 per year and this has increased to a maximum of $2500 per year.  Additional the licensee pays $25/year to go to the <a href="http://mda.mo.gov/news/2009/MDA_Announces_Operation_Bark_Alert">Department of Agriculture&#8217;s Operation Bark Alert</a>.  Operation Bark Alert is an effort to crack down on unlicensed breeders.</li>
	<li>Name change from the Puppy Mill Cruelty Prevention Act to the Canine Cruelty Prevention Act.</li>
	<li>Must make veterinarian records and sales records available upon request.</li>
	<li>The prohibition of anyone having more than 50 dogs for the purpose of breeding was removed.</li>
	<li>Where the state veterinarian OR an animal welfare official finds that past violations (last 2 years) have not been corrected the Department of Agriculture MAY refer such cases to the Attorney General.  The court can assess up to $1,000/violation</li>
	<li>Creating of the crime of canine cruelty, a Class C misdemeanor (could be punishable by 15 days in jail and $300 fine).  A second or subsequent offense is a class A misdemeanor (could be punishable by up to 1 year in jail and up to $1,000 fine).</li>
	<li>If a breeder is licensed under the Animal Care Facilities Act it is a Class A Misdemeanor to stack cages on top of one another without having an impervious layer between the cages.</li>
	<li>Begins a process to phase-in larger enclosures/cages for dogs and requires &#8220;unfettered&#8221; (to set free or be unrestricted) access to dogs for an outdoor area.

<p>So Proposition B is no more and many animal groups are declaring a compromise.  I am still confused as to what happened to the the rights of the voters of Missouri.  Governor Nixon stated, “But for the people of the state voting on this, we wouldn’t be here today. Their votes did matter. They fundamentally changed the discussion that was going on in our state.&#8221;</p>
<p>More to come as my main concern regarding these two new bills (and all along) will be <a href=" http://www.zoeystory.com/schindlers-list-part-i-yes-there-is-more/" target="_blank">enforcement</a> of these regulations.  How does the state of Missouri plan to enforce this and how many <a href=" http://www.zoeystory.com/schindlers-list-part-ii/" target="_blank">strikes before you are out</a>?</p>

Since the men commenting on what they&#8217;re seeing are speaking Japanese, I obviously don&#8217;t know exactly what they&#8217;re saying but one doesn&#8217;t need a translator to see the protective nature and love shared between this dog and his injured friend.</p>

<p>The dog brings the videographers directly to the sick animal and then protects his sick friend with his paw when he deems their approach a little too aggressive.  I was able to get the translation from the video and have posted it below, courtesy of Toshiyuki Kitamura:</p>
<p>&#8220;We are in Arahama area. Looks like there is a dog. There is a dog. He looks tired and dirty. He must have been caught in the tsunami. He looks very dirty. He has a collar. He must be someone&#8217;s pet. He has a silver collar. He is shaking. He seems very afraid. Oh, there is another dog. I wonder if he is dead. Where? Right there. There is another dog right next to the one sitting down. He is not moving. I wonder. I wonder if he is alright. The dog is protecting him. Yes. He is protecting the dog. That is why he did not want us to approach them. He was trying to keep us at bay. I can&#8217;t watch this. This is a very difficult to watch. Oh. Look. He is moving. He is alive. I am so happy to see that he is alive. Yes! Yes! He is alive. He looks to be weakened. We need to them to be rescued soon. We really want them rescued soon. Oh good. He&#8217;s getting up. It is amazing how they survived the tremendous earthquake and tsunami. It&#8217;s just amazing that they survived through this all.&#8221;</p>

<p>Images like theses make us yearn for a happy ending.</p>
<p>We want to help in any way we can be it in-kind donations, money or volunteering our time.  But unfortunately sometimes people can take advantage of videos like these that pull at our heart strings.  We want to make sure that any money given towards animal rescue post-earthquake/tsunami is actually used for the relief efforts.  In the case of this video we are still not sure what has happened to the two dogs or all the money collected by the &#8220;rescuer&#8221; <a href="http://ja-jp.facebook.com/kenn.sakurai1?sk=wall">Kenn Sakurai</a> via his <a href="http://ja-jp.facebook.com/kenn.sakurai1?sk=wall">facebook page</a>.  We do know that he continues to delete <a href="http://ja-jp.facebook.com/kenn.sakurai1?sk=wall">facebook posts</a> that are not to his liking and has indicated that he will return all donations in an interview with <a href="http://www.globalanimal.org/2011/03/19/japans-animal-victims-truth-news-vs-rumors-facebook/32951/">Global Animal</a>.</p>

<p>Every little bit helps.  As always at ZoeyStory, we are solely interested in helping those who cannot help or speak for themselves.  And while this story is a bit different from our usual focus on puppy mills, it nevertheless is of both immediate human interest and involves dogs and other animals damaged by this unfathomable tragedy not of their making.</p>
<p>Press reports have rightly focused on the human impacts from the earthquake and tsunami, leaving little time for the plight of animals like the ones in the video we&#8217;ve embedded above.  To all animal lovers like us, please do whatever you can to aid and protect those who can&#8217;t do so themselves.</p>

<p>As a reminder the dog whose owner refers to her as &#8220;it&#8221; lived in a disgusting, filthy box for 6 years since she was a puppy.  She slept, stepped,  lived and ate around 6 years of built up feces in a tiny 5 x 8 box made of rotting wood.  <br />We want to encourage everyone to continue to contact officials in Toombs County!  We were ecstatic to find out that Doug Eaves, the County Manager received over 4500 emails in one day regarding Alice.  Please continue to voice your concerns over the way this dog was treated, the killing of 77 dogs in one day at the Lyons Animal Shelter and this administration&#8217;s relaxed attitude towards animal welfare.</p>

			<content:encoded><![CDATA[During our investigation of <a href="http://www.zoeystory.com/lets-find-alice-her-wonderland-update/" target="_blank">Alice</a>, the &#8220;<a href="http://www.zoeystory.com/can-you-help-alice-the-dog-in-the-box/" target="_blank">dog in the box</a>&#8221; we&#8217;ve written about twice recently, we came to learn of a different problem in Toombs County, Georgia that also demanded our attention.  On January 20th 2011, <strong>ALL OF THE DOGS</strong> (approximately 77) at the Lyons Animal Control<strong> were euthanized</strong> in one day without prior notice.  These dogs, some of which were scheduled to be rescued the very next day, were then thrown into a large pit behind the animal shelter.

Not surprisingly, the incident has engendered accusations of animal cruelty by animal rights organizations, counter claims by the shelter that it had no choice and yet another black eye for the county.

No one knows all of the details (do they really matter given the outcome?) but the explanation provided at the ensuing Chamber of Commerce meeting by Lyons Public Works Director, Darel Corley, was that, &#8220;I cleaned the place.&#8221;  Corley is in a position to make such a decision: as Fire Chief, he has direct responsibility for the Lyons Animal Shelter, which is considered part of the Fire Department.  Corley subsequently stated publicly that the decision was made because the shelter was &#8220;overrun&#8221; with dogs and because he wanted to &#8220;start over.&#8221;  His newest idea of population control is &#8220;at the end of every month, whatever dog they can place, they can place (referring to <a href="http://sweetonionaps.org/" target="_blank">SOAPS</a>), and we&#8217;ll go ahead and euthanize whatever&#8217;s left and we&#8217;ll go ahead and move to the next month.”

Sounds like an easy enough plan, right?  Unfortunately, according to Holly Reynolds, foster chair at <a href="http://sweetonionaps.org/" target="_blank">Sweet Onion Animal Protection Society (SOAPS),</a> the local animal rescue organization that typically pulls most of the dogs out of Lyons Animal Control, indiscriminately putting down all animals at every months end would mean that some dogs would be euthanized without regard to when they arrived; animals are required to be in a shelter for 30 days before euthanization becomes an option.

Consider this: If you lived near Lyons, GA and lost your pet within a day or two of the end of a month, if it ended up at the Lyons Animal Control, Corley&#8217;s new plan would likely mean your pet would be put down before you had a full chance to find it.  No questions asked, no effort made, nothing.

Perhaps worse is the inhumane manner in which these animals were killed.  Nobody is saying which (or whether) veterinarian was on site on January 20th but the license of the attending veterinarian listed on the Lyons Animal Control website, Dr. Chris McRae, expired on 12/31/2010.   In addition, in a 2006 Department of Agriculture report Dr. McRae was cited for not only being unable to properly inject dogs but also for returning the animals to kennels post said faulty injection to &#8220;stagger and flop&#8221; until they died or another injection was attempted.  These reports also noted that Dr. McRae did not check for pulses (as is legally required) before throwing dogs in a “backhoe bucket” to be buried.

Even more damaging, a former employee at Lyons alleged that in 2010, unauthorized personnel euthanized dogs and that some had been buried before they were dead.  Another informant has come forward indicating he has seen animals beaten before they were killed and that if the Animal Control did not have appropriate medication, the dogs were simply shot.

SOAPS, which partnered with the mayor in 2009 to assist in adoption of as many dogs as possible from the rescue, is demanding answers.  Under its agreement a few years ago, SOAPS agreed to pay for the spaying and neutering of each animal that was adopted,  built the animal shelter new kennels and assisted in the adoption of between 300-400 dogs.  In sum, the organization has spent more than $195,000 assisting this single animal shelter.  Because of these efforts, euthanasia had not been performed between July 2010 and January 19, 2011.

Ms. Reynolds is horrified, stating that “They’re all dead. There were dogs that had just arrived Wednesday that were euthanized Thursday before their time was up.  We pulled dogs from there Monday, Tuesday, Wednesday and I told Tyler Corley (a shelter worker) that I would be back Thursday to pick up more and he said ‘OK.’  I called twice Thursday but no one would call me back.  They put down dogs that we had slated for adoptions.”

This issue is particularly resonant for us.  We adopted Zoey&#8217;s older sister, Abby, on August 2, 2006.  If the shelter we got her from had used the same process as Lyons Animal Control, she would have been euthanised two days earlier.  And we would have never had the chance to enjoy a lifetime of wonderful memories with our sweet, loving dog.]]></content:encoded>

We came to discover that Alice is actually owned by the elderly man’s (the one “housing” Alice) daughter. She showed <a href="http://www.petfinder.com/shelters/southerncomfort.html" target="_blank">Scott Bennett from Southern Comfort Animal Rescue </a>the purchase papers, which indicated that she had paid $500 for Alice. We were told that Alice had been bred “a couple times” but from the way her breasts sag, it certainly appears that she’s been bred more than twice.  So, it can be presumed that one reason the owners don’t want to get rid of her is because they could use her for breeding again.

The police officer that went to determine whether Alice was living under acceptable conditions allowed Scott (Southern Comfort Animal Rescue) to provide an acceptable baseline.  If the owners complied, they would be able to keep her.  Scott indicated that Alice needed more adequate shelter, specifically a kennel appropriate for a dog; she needed daily distributions of water and food as well as a complete medical examination.

The owners did in fact move Alice into a larger chain link kennel with an igloo style doghouse.  They are using a small bedpan style bucket for her water, although it isn’t nearly large enough to hold enough water for a pit bull for multiple days, so we can’t determine whether she’s being adequately hydrated.  Plus, for several days in a row Alice’s dog dish was overturned in the same position, leading us to believe that she either has not been fed or that the owners are continuing to throw her food on the ground.  Amazingly, a local police officer said that he was okay with Alice being thrown food, indicating that it is actually the way he feeds his dog (great). <a href="http://www.facebook.com/video/video.php?v=194406840586277&amp;comments" target="_blank"> New video of Alice here</a>

The owner did take Alice to a veterinarian, but it appears that the examination was only a standard “healthy dog” vetting.  This meant that the vet ran no tests to determine whether Alice has any medical problems, including internal parasites, heartworms, or other issues.

When Scott told the police and the magistrate judge that Alice needed further examination, they informed Scott that the case was dead, stressing that, “The dog is healthy. We looked at her and we can tell.”  Again, it strains credulity that these officials can tell that a dog is healthy just by looking at it; any good vet will counter that a full battery of tests must be run before making such a statement with certainty.

The magistrate Judge Matheson, said that he would not approve animal cruelty charges, because the way the dog was treated was “in the past,” and that her situation had changed.  I feel that it is also important to bear in mind that when Scott asked about previous years’ rabies certificates, Judge Matheson said that there was no law that says people have to get their dogs vaccinated.  Again, we find it necessary to give Judge Matheson a bit of a refresher in the Rules and Regulations for the State of Georgia regarding rabies vaccinations.  Here is the law for your state&#8230;try applying it:

<strong>Rabies Control Law-O.C.G.A-31- 19</strong>

Georgia law requires that <strong>all owned dogs and cats be vaccinated against rabies by a licensed veterinarian </strong>using approved vaccines in accordance with the national <em>Compendium of Animal Rabies Prevention and Control. </em>

Clearly this judge will continue to turn a blind eye to the law he is supposed to apply based on the facts presented.  He continues to make up the law as he goes stating that the animal cruelty that Alice endured is &#8220;in the past.&#8221;  Not surprisingly Judge Matheson continues to make up the law as he goes. There is no statute of limitations for animal cruelty and considering this was brought to your attention last month I am sure animal cruelty qualifies.

I’ll leave you on a final note that is continuously ringing in the back of my mind. First, Alice’s owner has indicated that she has <strong>FOUR</strong> other dogs.  I think most us are concerned about what conditions those animals are in currently.  Second, I’m interested in knowing what she is using them for because after we have seen the condition that Alice was subjected to, I’m afraid there may be a darker, and perhaps illegal, purpose for them.  Certainly it isn&#8217;t for a loving companion animal.

			<content:encoded><![CDATA[We were horrified to read about Alice, a 6-year old female Pit Bull from Toombs County, Georgia.  She came to the attention of rescuers in January after they found her living in a small, disgusting box, completely disregarded by a man who told authorities that he was taking care of the dog for his son-in-law who rarely visited (we’re afraid to find out what his definition of “rarely” means).  The man indicated that Alice was kept in the box because she was one of those “mean kind of dogs,” referring to the dog’s breed as  Pit bull.

First, let’s look at Alice’s living conditions for the PAST 6 YEARS:
•	Lived in a 5’x 8’ box since she was a PUPPY!
•	The box was constructed of rotted wooden boards, tin and chicken wire, constructed in way that Alice could only see sunlight through the cracks of the structure
•	The floor of the structure was never cleaned or washed, so Alice stepped, slept and lived on years of caked urine and feces
•	The water that was provided was disgustingly unsanitary
•	Her diet consisted solely of white bread, honey buns and occasional scraps that were thrown into the box via the slats in the wood

Rescuers contacted the man’s son-in-law to inquire as to whether they could purchase Alice to get her out of these filthy conditions but their offer was refused.  We can’t figure out why someone who never visited and self-evidently didn’t care about the animal would not want to receive money for it.
The rescuers countered that they would push for animal cruelty charges and contacted the sheriff of Toombs County to visit the premises; that man told the rescuers that he was sickened by what he saw and would indeed file charges.  However, Chief Magistrate John Matheson interceded by stating that he would “throw out” any charges of animal cruelty.

Really Judge Matheson?  As a judge, is it your responsibility to make a decision or reach a conclusion AFTER examining the factual evidence and, here is the important part, to form an opinion AFTER evaluating the facts and <strong>applying the law</strong>.  Judges are also supposed to be independent, impartial arbiters who do not impose their own prejudices or preconceptions into a case but rather apply the law as it applies to the facts at hand.
As a bit of a refresher, we’ve listed below the rules and regulations for the state of Georgia pertinent to this case, also known as the “Georgia Animal Protection Act.

§ 4-11-2.  Definitions
(4) &#8220;Humane care&#8221; of animals means, but is not limited to, the provision of <strong>adequate heat, ventilation, sanitary shelter, and wholesome and adequate food and water, </strong>consistent with the normal requirements and feeding habits of the animals size, species, and breed.

Ga. Comp. Rules &amp; Regulations r. 40-11-2-.01 (2011)

(1)	&#8220;Adequate food and water&#8221; means <strong>food and water, which is sufficient in amount and appropriate for the particular type of animal to prevent starvation, dehydration, or a significant risk to the animal&#8217;s health from a lack of food or water.</strong>

(a) Adequate food means <strong>palatable, non-contaminated, and nutritionally adequate </strong>food that is fed according to the species requirements or is fed as directed by a veterinarian. Adequate food does not include garbage.

(b) Adequate water means <strong>clean, fresh, potable water </strong>offered to pets at suitable intervals according to the species requirements, or as dictated by naturally occurring states of hibernation normal for the species, or as directed by a veterinarian.

(2) &#8220;Adequate temperature control&#8221; means indoor housing <strong>facilities for pets are sufficiently heated and/or cooled when necessary to protect the animals from excessive heat or from chilling, freezing or from any physical damage.</strong> Except for equines, the ambient temperatures should not be allowed to fall below 450F or rise above 850F, for animals that are not acclimated.

(3) &#8220;Adequate ventilation&#8221; means indoor housing facilities for pets are adequately ventilated to provide for the health of the animals at all times. Such facilities must be provided with <strong>fresh air either by means of windows, doors, vents, fans, or air conditioning and should be ventilated so as to minimize drafts, odors, and moisture condensation.</strong>

(14) &#8220;Humane care&#8221; of animals means, but is not limited to, the provision of <strong>adequate heat, ventilation, sanitary shelter, and wholesome and adequate food and water,</strong> consistent with the normal requirements and feeding habits of the animal&#8217;s size, species, and breed. Inhumane care includes any act, omission, or neglect, which causes unjustifiable physical pain, suffering, or death to any living animal.

(19) &#8220;Maintain&#8221; means to keep or keep up, or to keep in a certain condition.

(27) &#8220;Primary enclosure&#8221; means any structure or device used to restrict an animal or animals to a limited amount of space, such as a building, room, pen, run, cage, aquarium, hutch, stall, paddock, pasture, or animal transfer vehicle.

(31) &#8220;Sanitation&#8221; means the <strong>maintenance of conditions conducive to health and involves bedding changes (as appropriate), cleaning, and disinfection. </strong>Cleaning removes excessive amounts of dirt and debris, and disinfection reduces or eliminates unacceptable concentration of microorganisms. To sanitize, therefore, means to make physically clean, and, to the maximum degree practical, remove and destroy agents injurious to health.

§ 4-11-16. (2011) Penalties

(a) Except as otherwise provided in Code Section 16-12-4 or 16-12-37, any person violating any of the provisions of this article shall be <span style="text-decoration: underline;">GUILTY OF A MISDEMEANOR </span>and shall be punished as provided in Code Section 17-10-3; provided, however, that if such offense is committed by a corporation, such corporation shall be punished by a fine not to exceed $1,000.00 for each such violation, community service of not less than 200 hours nor more than 500 hours, or both.

(b) Each violation of this article shall constitute a separate offense.

If you’re similarly outraged by Judge Mathison’s callous indifference to Alice’s plight, please join us by signing this <a href="http://www.change.org/petitions/save-alice-aka-the-dog-in-the-box" target="_blank">petition</a> urging him to reconsider his opinion and bring an end to the horrendous circumstances Alice must endure.  <a href="http://www.petfinder.com/shelters/southerncomfort.html" target="_blank">Southern Comfort Animal Rescue (SCAR = A scar means the pain is over and the healing can begin) </a>has spearheaded this petition and is pushing for not only charges of animal cruelty but for Alice&#8217;s removal from the owner&#8217;s/son-in-law/daughter/etc care immediately.     Please take a moment to sign the petition <a href="http://www.change.org/petitions/save-alice-aka-the-dog-in-the-box" target="_blank">here</a> and write a letter or call Judge Matheson and Sheriff Knight of Toombs County.  Let Toombs County know that this horrendous behavior will not be tolerated.
